To the Members of the Magnolia Villas Homeowners’ Association;
MONTHLY ASSESSMENT INCREASE
Following our annual meeting on April 19, 2022 and we, the board, find it necessary to recommend an increase of our monthly maintenance assessment from $120 to $140 per month. With our current monthly assessment, we are not covering the full cost of our monthly expenses. This small increase would correct our operating deficit and allow us to withhold the use of our much needed savings account. At $140, our monthly assessment would still represent a lower cost to homeowners than other like communities in the Waco area.
In order to make this change, we are calling a brief meeting/ vote of the Homeowners’ Association Membership on July 7, 2022 at 7:00 p.m. Weather permitting, we will utilize the lawn of Jill Rix opposite 1205 Drake Ct. Please bring a lawn chair or something else for seating. Section 4.5 of our bylaws suggest that a two-thirds approval of the voting membership present (at least 60% of the available) at the meeting is required to make this change. Any individual not available to attend this meeting may send a proxy to vote in their stead.
We will offer a brief address of the state of additional action items but will not provide an agenda prior to the meeting at this time as the sole purpose of this meeting is to discuss and vote on the Monthly Assessment Increase. Should any discussion items be added, an agenda will be distributed prior to the meeting.
BYLAW SECTION 8.1 ANIMALS
Section 8.1 of our bylaws outlines the responsibilities of our homeowner’s in regards to
domesticated animals within Magnolia Villas. Highlighting specific points: “all animals must be commonly recognizable as domesticated,” “all animals must be kept indoors at night and when outdoors, must be on a leash and otherwise subject to the constant control and supervision of the Owner or occupant of the Lot.”
We are kindly reminding of and requesting adherence to these standards at all times. We have had a request to review the statement regarding leashes, but until such time, we will enforce this provision.
BYLAW SECTION 8.1 ANIMALS, cont’d.
To our understanding, we have several non-domesticated and untreated cats who have made Magnolia Villas their permanent home. In the interest of our community, its residents, and their pets, we are kindly requesting support in the removal of these cats in the following ways:
Please do not provide food for these cats. We consider provision of food a violation of Section 8.1 and the Lot Owner may be subject to fine under provision 11.5.4.
If any of these cats belong to a specific Lot Owner or occupant, please keep this cat indoors.
If you would like a “community cat” to be domesticated, please take it to the Waco Humane Society or a veterinarian to have it spayed/neutered and to receive necessary vaccinations. Then please keep the cat indoors.
Any trapped cat may be taken off premises, preferably to the Waco Humane Society.
The board will be contacting both the Waco Humane Society and Animal Control beginning on
June 13, 2022 to support removal of any “community cats” from Magnolia Villas. All domesticated cats must be indoors by this point.
LAWN MAINTENANCE
A request was made to Cromwell Mgt. to research and provide quotes for lawn maintenance
from at least three other providers after the April 19th meeting. Since this time they have only provided one quote that exceeds our budget. It was also requested that a series of additional services and requests be provided to Turf Masters, our current lawn maintenance, for them to provide a new quote for care. This has not been provided either. The board will be following up with our new representative from Cromwell Mgt. as well as seeking this requested information. We hope to provide you with a full update on lawn maintenance options on July 7th, but until that time, we have provided care requests to Turf Masters to address some of the present concerns and would encourage correction from individual residences directly to the employees during service as necessary.
APRIL 19TH MEETING REQUESTS
It is our understanding that the requests provided to Cromwell Mgt. at the April 19th meeting
have not been addressed. We have requested that the community requests be provided to the board so we can take steps to address these requests.
